These Terms of Service ("Terms") govern your access to and use of the Gigawork platform and services ("Service") operated by Moonlet Technologies ("Gigawork," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
Gigawork provides a work automation platform delivered through messaging channels. The Service enables businesses to deploy AI agents across messaging channels including WhatsApp, Messenger, Instagram, SMS, and Email. These agents track goals, manage tasks, extract structured information, and automate operational work through natural conversation with your contacts. The Service includes message processing, task tracking and response generation, business resource management, conversation oversight, and related tools accessible through a web-based dashboard.
To use our Service, you must be at least 18 years of age, have the legal authority to enter into these Terms, and operate a legitimate business entity. You must also comply with all applicable policies of the messaging channel providers whose platforms you connect through our Service. By using our Service, you represent and warrant that you meet these requirements.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
Your use of the Service involves third-party messaging platforms. You are responsible for ensuring that your use of the Service complies with the policies of each messaging channel provider you connect, including opt-in requirements, message template approval requirements where applicable, content restrictions, and rate limits. We reserve the right to suspend or terminate your account if your use violates these policies or risks the standing of our platform integrations.
The Service uses artificial intelligence to process messages, track goals and tasks, extract structured information, and generate responses on your behalf. While we design the system for accuracy and reliability, AI-generated output may sometimes be incorrect, incomplete, or inappropriate. You are ultimately responsible for the messages sent to your contacts through the Service and for the accuracy of information extracted and tracked by the AI agent. We recommend reviewing your agent's configuration, monitoring conversations, and verifying critical data extracted by the system. We are not liable for any damages arising from AI-generated content or automated actions performed through the Service. Phone verification may involve device signal collection and bot detection. Users who block these mechanisms may be unable to complete verification.
You may upload documents and other materials to the platform for use by your AI agent. You represent and warrant that you have the right to upload and use these materials, and that they do not infringe on any third party's intellectual property rights. We process uploaded resources as described in our Privacy Policy. You retain ownership of your uploaded materials.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.
You are responsible for obtaining any necessary consents from your contacts before their personal information is processed through the Service. You must comply with all applicable data protection laws and regulations in your jurisdiction.
The Service, including its software, design, text, graphics, logos, and other content, is owned by Gigawork and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works of the Service.
You retain ownership of your business data, including conversations, uploaded resources, and business information you provide through the Service.
Access to the Service may require payment of fees as described in your subscription plan. Agent plans and business tier pricing are published on our platform. You pay each invoice by a method it offers, such as mobile money or bank transfer, and a payment counts once we have confirmed it. Fees are non-refundable except as required by law or as otherwise stated in your service agreement. We reserve the right to change our pricing with reasonable notice.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including downtime of third-party messaging channel providers. We are not liable for any damages resulting from service interruptions.
To the maximum extent permitted by law, Gigawork shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the fees paid by you to Gigawork in the twelve months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times, or that AI-generated output will be accurate, complete, or appropriate for your use case.
You agree to indemnify, defend, and hold harmless Gigawork and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content transmitted through the Service on your behalf.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, and indemnification clauses.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Pennsylvania.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
